 Re: New Order

 Dear Sirs:

 As a follow up to our earlier email request dated January 12,2007 please find enclosed
 our full payment in the amount of $5,900.00.

 This order is for the receipt of an Allerca GD hypoallergenic kitten. The amount includes
 our request for a premium placement order, (approximately 7-9 months).

 We understand the kitten will be approximately 12 weeks old, spayed or neutered and
 will have all the required shots when we receive her/him.

 We do not have a preference for a male or female or a particular color.

 Also, once the kitten is ready for delivery it is our preference to pick up the kitten at a
 veterinarian near your facility or near the Los Angeles airport. We would prefer to hand
 carry the kitten on its long way home to Anchorage, Alaska.

 Looking forward to hearing from you and the soonest date we can receive our new familyaddition!

 Dear Sirs:

I attempted to phone your offices, using (2) different Allerca numbers but was unable to reach
anything more than a recording machine.

Please review this email message and provide a response at your very earliest convenience.

We provided a payment in the amount of $5,900.00 via check and a personal letter
dated January 20, 2007 restating the conditions of our order.

 Our payment amount was for (1) X Allerca Hypoallergenic Kitten @  $3,950.00.
 Additionally, we paid for a premium placement at a fee of$I,950.00 per
 kitten.

 In our letter and in the earlier phone conversation with an Allerca Sales
 Representative, premium placement provided for delivery within 7-9 months and
 standard placement within 15-18 months. We elected to pay the premium
 placement based on the delivery information provided by the representative.

 I spoke to your offices in late August inquiring on our order status and I
 was told  I would be receiving information from Allerca by September 25th in regards
 to the color and sex of the kitten and delivery by October 25th.

 All dates have passed and we have received no information from Allerca.

 My husband phoned Allerca a few weeks ago only to be told delivery is now scheduled
 for January 2008.  Needless to say, we are extremely disappointed in the manner in which  Allerca is conducting business.

 To date, Allerca has not complied with our written understanding and your
 verbal commitments.

 Therefore, we would like to cancel our order AND have Allerca return our
 payment in  full in the amount of $5,900.00.

 Much press has been given to your company about the breakthrough of being
 able to obtain a "hypoallergenic" kitten but I'm positive your customers (current
 and future) are/were expecting a higher level of service, professionalism and
 responsiveness.

 Please response to this message with your intentions.

 We do have you up for a delivery on January 18th; this is a firm date. I
 expaliend to your husband that cat breeding is not an exact science and
 that the dates provided are an indication only.

 However, I understand if you are disappointed and will provide a refund if
 you so wish. If however you prefer to wait for delivery of your kitten, we
 can hold your reservation. Please advise.

 I also appreaicte that out phone system can be frustrating so I am happy to

 Today is March 9th and we have received two follow up phone calls from
 Allerca, but yet again more broken promises. Please consider this our
 formal notice to cancel our order placed to Allerca on January 20, 2007. As
 mentioned in our previous email below, we paid an expedited delivery fee
 expecting (as verbally guaranteed) to receive our new kitten within 7-9
 months. It should be noted, we are currently in the 14th month of our
 original order date.

 You are requested to return our payment in full in the amount of $5,900.00
 within (15) days of this message to the address noted below.

 While we do provide estimates, unfortunately we are dealing with live
 aninals and can never accurately predict delivery dates.

We do not take kindly to threats, and our offer to refund you has been withdrawn. As per the terms and conditions of your purchase, your purchase is non -refundable. You also agreed that subject to the terms and conditions, that we have the absolute discretion when to provide such a kitten.

Please note that ANY action to interfere with our business will be handled by our attorneys and we will (as we have in the past with others) pursue you legally for damages.

We will advise when a kitten is available.
